The company DYGEST, a simplified single-shareholder joint-stock company (SASU) with a share capital of 1,200,000 euros, registered with the Versailles Trade and Companies Register under number 977 964 956, with its registered office at 22 rue du Président Wilson – 78230 Le Pecq, France, is the publisher of the Dygest application (hereinafter the "Application"), hosted by Amazon Web Services, 410 Terry Avenue North, Seattle, WA 98109-5210, USA. The Director of Publication is Mr. Hatem Ahmed. EU VAT number: FR94977964956.
These Terms and Conditions of Use define the general terms and conditions under which Dygest makes the Application (hereinafter the "Application") available to the Member (hereinafter the "Member"), and the conditions under which the Member may access the Application. They are supplemented by the Privacy Policy.
Accessing the Application constitutes acceptance by the Member of these Terms and Conditions of Use and the Privacy Policy.
By clicking on the "Sign in with Facebook" or "Sign in with Google" button, you acknowledge that you have read and accepted these Terms and Conditions of Use in their entirety.
If you do not accept all of the Terms and Conditions of Use, please do not use the Service.
Service Offering
Dygest offers access to non-fiction book summaries. You can grasp the essence of a book without having to read it in full. Summaries are written by a pool of academics (doctoral students, associate professors, university professors) ensuring quality. You can access written or audio versions of the books. You can select passages from the summary and save them to your interface. You can access books through search or by browsing categories. You can access books currently being read.
Access to the Service
You can create an account for free, but to access all content, you will need to subscribe. A subscription is not mandatory, but you understand that without subscribing, your use of the platform will be limited.
Before validating the creation of their Client Account, the User must read the Terms and Conditions of Sale, and creating their account constitutes validation thereof. You can subscribe monthly or annually to unlock the entire written and audio catalog of summaries.
The User is informed that the Company may modify and/or update the terms of the T&Cs due to economic or legal requirements; Clients currently using the Services will be informed and will have 8 (eight) days to notify by regular mail or email their refusal of the proposed modifications and consequently request the deletion of their Client Account. Otherwise, the proposed modifications will be considered tacitly accepted by the Clients and the contract will continue until its term. The Company reserves the right to modify the characteristics of the Services at any time, provided such modifications do not result in substantial changes.
Paid Subscription Terms
To access the full reading and audio catalog, the Client must subscribe to one of the Subscriptions offered on the Application. These can be purchased for different and variable time periods, which you will see in the order options.
Subscription prices are indicated on the Application when clicking "read" or "listen" in the presentation of each book. Users are informed that subscription prices may change over time and at any time as part of promotional offers. The Company makes no commitment that these prices will not change. The Client has the option, at any time during the subscription process, up to the actual payment, to return to the subscription to complete, modify, or cancel it.
To pay, you must select the desired option on the subscription screen in the app, and a pop-up will appear where you will need to enter your password for the third-party app store. Once completed, a pop-up will appear where you must confirm the subscription purchase again. At this point, you can still cancel the process. You should then receive an acknowledgment of receipt from the third-party App Store.
Payment Terms
Payment is due at the beginning of the subscription. The subscription is made directly within the iOS or Android applications, and payment is processed through Apple or Google's built-in purchase process.
As part of your subscription access, your subscription will be automatically renewed at the end of the relevant subscription period if you do not cancel your paid subscription at least 24 hours before the end of the period.
Once payment has been made, a printable and savable summary of the Client's subscription will be displayed, including its references.
By clicking the "Pay" or "Subscribe" button during the subscription process, the Client declares full and unreserved acceptance of these Terms and Conditions of Sale. Dygest will systematically confirm each Client's subscription to the Service, and the availability of reading materials and audio on the application, by email, with a subscription summary.
Refund Policy
Purchase via iTunes
Please contact iTunes customer service for a refund. Please also note that all purchases made through the Apple App Store are subject to their Terms and Conditions. For all purchases made on iTunes, Apple acts as distributor and handles refunds. Please also cancel the next automatic renewal of your Dygest subscription in your iTunes account.
Purchase via Google Play
Please contact Google Play customer service for a refund. Please also note that all purchases made through the Play Store are subject to their Terms and Conditions. For all purchases made on the Play Store, Google acts as distributor and handles refunds. Please also cancel the next automatic renewal of your Dygest subscription in your Google Play account.
Trial Period
Dygest offers new users a free Subscription for testing purposes for a certain period of time ("Trial"). Dygest reserves the right to interrupt or modify this free trial at any time without prior notice or notification.
You may only participate in certain trials if you enter your payment information when signing up. In such a case, we need your consent at the start of the trial so that your free access converts to paid subscription access the day after the trial ends. In this case, your subscription renews on a recurring basis and can be canceled up to one day before the end of the respective subscription period.
If you do not wish to benefit from the Subscription and associated fees, you must cancel your Subscription Access granted during the Trial before the end of the Trial (in the respective App Store or Google Play Console settings).
Duration and Cancellation
The paid subscription will last at least the term you initially selected and will be automatically renewed if not canceled at least 24 hours before the end of that period. The subscription duration will be extended according to the subscription model used so far. You can cancel a paid subscription completed via iOS or Android apps in your iTunes or Google Play settings.
Cancellation of subscription access takes effect the day after the last day of your current subscription period, and you will be downgraded to the free usage agreement (free account). However, once you renew a subscription, you will be able to access your previous status and reading lists.
Intellectual Property
Dygest is the exclusive holder of intellectual property rights on the site and the Application, including all texts whether in written or audio format. Each Author, prior to publishing their summary on the application, has assigned their editing rights, exclusively authorizing the Company to edit and distribute it to the public. All these intellectual creations are protected under copyright law and trademark law worldwide. These creations are the full and entire property of Dygest.
Dygest grants its subscribers a license to reproduce and display the content of the Site and Application, but strictly limited to personal and non-collective use only. This license excludes the right of Clients to modify, copy, translate, broadcast, publish, transmit, distribute, produce, display, or assign rights to any content appearing on and through the platform.
In accordance with the provisions of the Intellectual Property Code, only private use is authorized, subject to different or more restrictive provisions of this code. Any other use constitutes infringement and is punishable under Intellectual Property law without prior authorization from Dygest. Any form of total or partial copying, scraping, and reproduction of the produced database is formally prohibited without prior written consent.
Technical Provisions
Dygest's services are provided as-is and subject to availability. Dygest does not guarantee error-free, uninterrupted, and secure provision of services offered via the Site and/or Application and is not bound by any obligation of personalized assistance, particularly technical.
Dygest shall not be held liable for any inconvenience or damage inherent to the use of the Internet, including service interruption, external intrusion, or the presence of computer viruses. Dygest is not responsible for failure to meet its obligations as defined herein resulting from force majeure.
Without prejudice to the provisions of the preceding paragraphs, Dygest's liability under these terms of sale cannot exceed an amount equal to the sums paid or payable in the transaction giving rise to said liability, regardless of the cause or form of the action concerned.
Entirety of the Agreement
These Terms and Conditions of Sale and the subscription summary transmitted to the Client form a contractual whole and constitute the entirety of the contractual relations between the Parties. Generally, it is agreed between Dygest and the Client that emails shall be binding between them, as well as the automatic recording systems used on the Site and Application, particularly regarding the nature and date of the subscription.
Severability
If one or more provisions of these Terms and Conditions of Sale are held to be invalid or declared as such under a law, regulation, or following a final decision of a competent court, the other provisions shall retain their full force and effect.
Applicable Law — Disputes
The applicable law to these terms of sale is French law. Subject to contrary provisions of the Code of Civil Procedure, any dispute that may arise regarding their validity, interpretation, or performance, and which has not been settled amicably by the parties, shall be submitted to the courts of Paris, notwithstanding plurality of parties, interim proceedings, or expert proceedings.
